1. Applicability
These General Terms and Conditions apply to all deliveries of Stonecheck.de to the consumer, basing on german right (§ 13 BGB).

3. Offer and contract formation
3.1 The display of the products in the online shop does not represent a binding offer, but rather a call to order. All offers are available “while stock lasts”, if nothing to the contrary has been marked by the products. Errors excepted.
3.2 By clicking the button “Complete Order” in the last step of the ordering process, you will submit your binding order for the products contained in the shopping cart. The purchase contract comes into being after your order was accepted with an order confirmation via email immediately upon receipt your order.

5. Right of withdrawal
Consumers (§ 13 BGB) have a legal right of withdrawal.
Cancellation instructions
Within two weeks you can cancel your contract without cause in text form (e.g. letter, fax, e-mail) or by returning the product. The cancellation period starts no sooner than with the receipt of these instructions. In order to safeguard the cancellation period, the timely sending of the cancellation and/or product is necessary. The cancellation is to be sent to:

Cancellation consequences
In case of an effective cancellation the services received on either side are to be returned and/or any benefits derived (such as interest) are to be surrendered. If you can not return the received services entirely or in part, or if such can only be returned in a deteriorated state, you have to provide the respective compensation. In cases in which products have been released, this is not applicable if the worsening of the product is only attributed to the inspection of such (similar to an inspection that you would normally perform when purchasing the product at the store). Furthermore you can avoid the compensation duty by not using the product as though it was your own and avoid actions that diminish its value. Products that can be returned as a package are to be sent back. Products that can not be sent back as a package will be picked up. You are responsible for the costs relating to the return of the product, if the delivered product conforms to the product you ordered and the price of the product that was returned does not exceed 40 Euros or (in case of a higher price) if you have not submitted your compensation or a contractually agreed upon partial payment at the time of the cancellation. Otherwise the return is free of charge for you. Your payment obligations need to be met within 30 days after sending your cancellation notice.
Please note:
Your right to withdraw expires prematurely if your contractual partner has started to provide his services with your expressed consent prior to the end of your cancellation period or if you have initiated such yourself (such as by downloads, etc.).

6. Prices and shipping costs
6.1 The prices shown on the product pages include the value added tax and other price components.
6.2 The shipping costs depend on the amount of products ordered, as well as the shipping method and will clearly be disclosed to you prior to submitting your order. You will find an overview on the page “Shipping”.
7. Delivery
7.1 Delivery is only possible within Germany.
7.2 Generally speaking the delivery time is 3 workdays. In case of differing delivery times we will mention such on the respective product pages.
7.3 Should the ordered product not be deliverable in a timely manner, due to the fact that we have not been supplied by our supplier in time, we will inform you of such immediately. In that case you can choose to either wait for the product or to cancel your order. In case of a cancellation any possibly rendered services will be reimbursed immediately.
8. Payment
8.1 Payment choices are C.O.D., invoice, money transfer, direct debit or credit card.
8.2 When choosing prepayment, we will provide our bank details in the order confirmation and deliver the product after payment has been received.
8.3 You will only be entitled to the right of offset if your counterclaims have been legally determined in front of a court of law or if such have been acknowledged by us in writing.
8.4 The right of retention can only be utilized in as far as such claims result from the same contractual relationship.
